Draft Federal Regulations to be Released Designating Self-Funded Student Health Plans as Minimum Essential Coverage

The Department of Health and Human Services has announced the upcoming release of draft federal regulations that, among other provisions, will designate self-funded student health plans as minimum essential coverage under the Affordable Care Act (ACA). Notice of Proposed Rulemaking is expected to be published in the Federal Register on or about February 1, 2013: Patient Protection and Affordable Care Act; Exchange Functions: Eligibility for Exemptions; Miscellaneous Minimum Essential Coverage Provisions (CMS-9958-P). Comments on the proposed rule will be due 45 days after the publication date in the federal register.

At initial reading, we are pleased that this proposed rule will afford minimum essential coverage recognition for students covered by self-funded student health benefits plans at institutions of higher education.  ACHA will be examining this proposed rule in further detail to determine any other potential effects on students’ health coverage going forward. Additionally, we will continue to monitor developments on other issues related to ACA implementation that affect college students
